Late arrivals may result in shortened tour time or cancellation of participation depending on operational limitations and safety considerations.
No refund will be provided where participation is denied or terminated due to:
- Intoxication or suspected drug use;
- Unsafe, reckless, or aggressive behavior;
- Failure to follow staff instructions;
- Failure to meet age, weight, or participation requirements;
- Refusal or failure to sign the required waiver;
- Providing false, misleading, or incomplete information.
5. Weather, Sea Conditions, and Force Majeure
Safety is our priority. Weather and sea conditions are monitored closely to ensure a safe and enjoyable experience for all participants.
If unsafe weather or sea conditions are identified in advance and the tour cannot safely proceed, Wave Riders will first attempt to reschedule the booking to another available date or time. If rescheduling is not possible, a full refund will be provided.
Ocean and weather conditions may change unexpectedly. Wave Riders reserves the right to delay, shorten, modify, relocate, or cancel a tour at any time if conditions are considered unsafe or unsuitable by our guides or staff.
In certain situations, including sudden weather changes, rough sea conditions, medical emergencies, mechanical breakdowns, harbor restrictions, governmental actions, fuel shortages, or other circumstances beyond our reasonable control, partial interruptions or modifications of the tour may be necessary without entitlement to additional compensation.
Wave Riders shall not be liable for delays, route changes, shortened tours, discomfort, missed activities, or cancellations resulting from circumstances beyond our reasonable control where reasonable safety and operational decisions were made.
6. Guided Tours Only
All Wave Riders activities are guided tours. We do not offer unguided jet ski rentals.
Participants must follow all instructions and directions provided by guides and staff at all times.
Routes, stops, sightseeing locations, launch locations, pace, and itineraries are planned in advance where possible, but the final route and operational decisions always remain at the discretion of the guide.
7. Tour Modifications and Operational Flexibility
Tour routes, departure points, sightseeing locations, stops, and duration may be modified for safety, weather, operational reasons, participant ability, marine traffic, sea conditions, or other circumstances deemed relevant by Wave Riders staff.
Reasonable changes to the itinerary or route do not automatically entitle participants to a refund or compensation.
8. Participation Requirements
Drivers must be at least 16 years old. Passengers must be at least 8 years old.
A maximum of two riders is permitted per jet ski, provided the combined weight does not exceed 204 kg / 450 lbs.
Participants must be physically capable of safely participating in the activity and should be comfortable in open water conditions.
Participation is not recommended for individuals with serious medical conditions including, but not limited to, serious back or neck injuries, epilepsy, heart conditions, significant vision impairments, or pregnancy.
No boating or driver’s license is required; however, all drivers remain fully responsible for operating the jet ski safely and responsibly.
9. Minors
Participants under 18 years of age must have written consent from a parent or legal guardian and must be accompanied by a responsible adult during the activity.
A parent or legal guardian must sign the required waiver on behalf of any minor participant.
10. Waiver Requirement
Every participant, including passengers, must complete and sign the required waiver before the tour starts.
Participants who refuse or fail to complete the waiver documentation will not be permitted to participate in the activity.
Failure or refusal to sign the waiver does not entitle the participant to a refund.
11. Safety and Conduct
Participants must behave responsibly and respectfully toward guides, staff, other participants, swimmers, marine life, vessels, and the surrounding environment.
Unsafe, reckless, dangerous, aggressive, or disrespectful behavior may result in immediate termination of participation without refund.
Required safety equipment, including life vests or flotation devices, must be worn as instructed during the activity.
12. Right to Refuse Participation
Wave Riders reserves the right to refuse participation to any person for safety, operational, behavioral, medical, intoxication-related, legal, or environmental reasons.
If participation is refused due to the participant’s own conduct, behavior, intoxication, failure to meet requirements, refusal to follow instructions, refusal to sign the waiver, or false information provided during booking, no refund will be provided.
If participation is refused for operational or safety reasons not caused by the customer, Wave Riders may offer a reschedule, partial refund, or full refund depending on the circumstances.
13. Damage and Equipment Responsibility
Participants are financially responsible for any loss of or damage to jet skis, safety equipment, accessories, or other property caused by negligence, misuse, unsafe operation, reckless behavior, collision, failure to follow instructions, or violation of safety rules.
Participants agree to reimburse Wave Riders for all related costs, including repair costs, replacement costs, recovery costs, towing costs, third-party damages, and loss of operational income resulting from the damage.
Participants remain financially responsible regardless of whether a security deposit was collected.
Normal wear and tear and mechanical failures not caused by the participant are excluded.
14. Personal Belongings
Participants are responsible for their own personal belongings at all times.
Wave Riders is not responsible for loss of, theft of, or damage to personal items including phones, cameras, sunglasses, wallets, jewelry, GoPro devices, or other valuables brought during the activity.
15. Photos, Videos, and Promotional Media
Photos and videos may be taken during the activity for promotional, advertising, social media, marketing, or commercial purposes.
By participating in the activity, participants acknowledge that they may appear in such media unless they inform us otherwise before the tour starts.
Photos and videos may be included as part of the experience; however, they are not guaranteed. Equipment failure, weather conditions, sea conditions, technical problems, visibility, or operational circumstances may prevent media from being captured or delivered.
Failure to receive photos or videos does not entitle participants to a refund unless expressly sold as a separate paid service.
16. Limitation of Liability
Participation in jet ski and ocean-based activities involves inherent risks.
Wave Riders shall not be liable for injury, death, loss, damage, delay, inconvenience, additional expenses, or indirect damages arising from participation in the activity except where liability cannot legally be excluded under Curaçao law.
Nothing in these Terms & Conditions excludes liability for gross negligence, intentional misconduct, reckless conduct, or liabilities that cannot legally be excluded under applicable law.
